Authorized RFxPremier Fulfillment Partners for the State

The following Cisco fulfillment partners 1) currently qualify under Cisco's established fulfillment partner selection criteria for the above-referenced Cisco Prime Contract, and 2) have been authorized by the State to participate as Cisco Subcontractors under that agreement:

Eligible Users: This addendum covers the RFxPremier Master Agreement for Data Communications Products and Services led by the State of Montana (Lead State) for use by agencies, as defined in section 287.012, F.S., or eligible user, as defined in Rule 60A-1.001, Florida Administrative Code (“F.A.C”), that makes a purchase off the term Contract. For the avoidance of doubt, this also includes the Department when it purchases off the Term Contract.

Scope of Offerings: The full suite of product and service offerings available under the PA.  Refer to MA, Att 3.

Special Terms and Conditions on Orders: Terms. The terms of the Form PUR 1000, General Contract Conditions, incorporated in Rule 60A-1.002, F.A.C., and linked here, are hereby incorporated by reference herein and will apply to all purchases made by a Customer off the Term Contract. The Customer may attach additional terms and conditions specific to its particular purchase made off the Term Contract, which are considered Special Conditions. Refer to PA, Exhibit C, §5.3.

Shipping and Delivery Information: Shipping terms are FOB Destination, freight pre-paid, for the standard shipping time intervals. Expedited shipping and/or a special delivery request that are non-standard delivery will result in additional charges to the Purchasing Entity. Refer to MA, §8 and PUR 1000, §5.e.

Limited Fulfillment Partner Professional Services: Subject to Contractor's approval and the certifications held by its Fulfillment Partner, Fulfillment Partner can offer and provide limited Fulfillment Partner Professional Services: Certified and Technical Project Management, Staging and Implementation Engineering (Installation), Site Survey, High Level Design Review, Global Implementation Capability, Configuration Development, Knowledge transfer and Acceptance Testing. Refer to the Basic Install and Config webpage.

Leasing or Alternative Financing Methods: Leasing and financing arrangements are subject to State of Florida statutory guidelines, including Section 287.063, F.S. (Consolidated Equipment Financing Program / CEFP) for state agencies, or customer-specific financing agreements through Cisco Capital and approved financing partners. Refer to MA, §6.3 and PUR 1000, §7.f.

Minimum Insurance Coverage: Refer to MA, §13 and PA, PUR 1000, §8.e.

Purchase Orders: The MA number # SPSD26-0563LS_CIS and the Florida Contract Number # 43220000-PPA-26-ACS must appear on every PO placed under the PA. Refer to PA §3.

Final Sale: All sales are final. Except for return remedies set forth in Contractor’s thencurrent return policies, Contractor only permits the return of unopened hardware Products due to Contractor’s shipping or other processing errors. No other returns are authorized. The return of all Products (including Software) shall be in accordance with Contractor’s then-current return policy and procedures. Warranty returns will not be subject to any restocking fees. Refer to MA, §8.8

Marketing & Advertising Restrictions: Prior written approval from the Florida Department of Management Services (DMS) is required before publicly disseminating any promotional material, press releases, or identifying the Department or State as a reference (Exhibit C §12.4). All marketing requests must be routed to Cisco CMO at contract-help@cisco.com.

Refurbished Equipment: Only new, standard manufacturer products are supplied under the contract. Cisco factory-certified remanufactured equipment (Cisco Refresh) is permitted only when expressly requested and authorized by the purchasing Customer.

Verify the tax-exempt status of the customer before charging sales & use taxes.

All contract requirements and sales are subject to audit.

Minimum Required Discounts: See RFxPremier Master Agreement Attachment H

The discounts listed above are the minimum contract discounts required. The listed Authorized Fulfillment Partners must provide, at a minimum, those discounts and cannot offer less favorable pricing discounts than the contract discounts. Authorized Resellers may offer any additional, incremental discounts to any eligible users under this contract and such additional discounts if offered, may be provided at the discretion and as the sole legal obligation of the Authorized Resellers.

Cisco Systems, Inc. ("Cisco") requires Purchase Orders under the RFxP Cisco Master Agreement #SPSD26-0563LS_CIS and each State's RFxP Participating Addendum to be processed through our Authorized Fulfillment Partners.

Blanket POs are not allowed under the contract.

Additional or conflicting PO terms that bind Cisco are not allowed under contract.

Purchase Order Instructions

1. Select one of the Authorized Fulfillment Partners listed.
2. Issue the Purchase Order directly to the selected Authorized Fulfillment Partner.
3. Reference the RFxP #SPSD26-0563LS_CIS and your State's RFxP Participating Addendum contract # on your Purchase Order.
4. Include the following contact info: Your customer name and phone number, "Ship To" and "Bill To" addresses.

Authorized Fulfillment Partners will directly ship the orders placed to the identified "Ship To" address (es). Customers will then be invoiced directly by the Authorized Fulfillment Partners. Payments must be made in accordance with the terms of the RFxP Cisco Master Agreement #SPSD26-0563LS_CIS and your State's respective RFxP Participating Addendum.

Warranty Terms

Please refer to the RFxP Cisco Master Agreement #SPSD26-0563LS_CIS  and your State's respective RFxP Participating Addendum for warranty terms.

Repair or Replacement of Products

Please directly contact the Authorized Fulfillment Partner who processed your original Purchase Order for the Cisco Products. Subject to the warranty terms of the RFxP Cisco Master Agreement #SPSD26-0563LS_CIS  and your State's respective RFxP Participating Addendum, the Authorized Fulfillment Partners will work with you and Cisco on the matter.
