DEFINITIONS CARE (Program) refers to the Cisco Authorized Refurbished Equipment Program.
Cisco CARE Reseller means a Reseller authorized by Cisco to distribute CARE Equipment
Hardware is the tangible portion of the CARE equipment.
CARE Equipment means, individually or collectively as appropriate, hardware, licensed Software, Documentation, developed products, supplies, accessories, and goods to the foregoing, as quoted or listed by Cisco Systems or a Cisco Distribution Partner.
Cisco Distribution Partner means a distributor authorized by Cisco to distribute Products and Services within EMEA ("Cisco Distribution Partner" or "CDP") in accordance with a Cisco Distribution Partner Agreement between Cisco und the CDP.

TERMS AND CONDITIONS
3.1
The Cisco CARE Reseller understands that the supply CARE equipment is strictly subject to the availability of any CARE Product, and Cisco Approval for positioning of CARE equipment with the End-user.
3.2
The Cisco CARE Reseller acknowledges that each CARE Product made available by Cisco through a Cisco Distribution Partner has been previously used. The Cisco CARE Reseller agrees that, in its resale of any Refurbished Product, it will:
not remove any label or other markings provided by Cisco with such products that refer to the Refurbished Products as used or refurbished, or part of the "CARE Program";
at all times during resale of the CARE Products, advertise, promote, or resell each such product as used or refurbished, and thus part of the "CARE Program"; and
that it shall not in any case hold any CARE Products out to be, or in circumstances where any Authorized Channel and/or End User might reasonably believe them to be, new Products;
promptly notify Cisco in the event it becomes aware that any Authorized Channel or any other person to which Cisco (Distribution Partner) has sold or transferred CARE Products, has (a) removed any label or other markings provided by Cisco with such products that refer to the CARE Products as used or refurbished; or (b) advertised, promoted, or resold any CARE Products as new or unused.
3.3
The Cisco CARE Reseller shall send relevant and correct End User data at the point of requesting approval for positioning CARE equipment for the end user, as well as at the point of ordering CARE equipment with the Cisco Distribution Partner after such an approval has been given. Also, the Cisco CARE Reseller agrees to send a copy of the End-user Purchase Order and End-user contact email-address to the Cisco Distribution Partner in case a CARE purchase order is being placed on the Cisco Distribution Partner.
The Cisco CARE Reseller understands that Cisco may send information about CARE Products to the end-user email-address in order to ensure that the end user is properly informed about the products that they purchased.
