Cisco Changing the Game Competition
NO PURCHASE NECESSARY TO ENTER OR WIN. INTERNET ACCESS IS REQUIRED TO ENTER. OFFERED AND OPEN ONLY TO THOSE ELIGIBLE ENTRANTS WHO ENTER FROM WITHIN THE COUNTRIES OF : AUSTRALIA







1. ELIGIBILITY:

The Cisco Australia "Changing the Game ("Contest") is open only to legal residents of [ Australia, ] who are eighteen (18) years of age or older at the time of entry ("Entrants"). Void where prohibited by law. Employees of Cisco Systems, Inc. and its subsidiaries, affiliates, and entities engaged in the development, distribution and implementation of this promotion and the immediate families (parent, child, siblings, spouse) and members of the same household (whether related or not) of such employees are not eligible to enter or win a prize. Subject to all applicable federal, state, provincial and local laws and regulations. All Entrants are responsible for compliance with any contractual limitations and/or office policies, if any, regarding participation or prize acceptance in the Contest.

2. SPONSORS:

The Contest is sponsored by Cisco Systems, Australia Pty Ltd located at L9, *0 Pacific Highway North Sydney NSW 2060 (the "Sponsor"), which is a subsidiary of Cisco Systems Inc. located at 170 West Tasman Drive, San Jose, CA 95134, USA.

3. AGREEMENT TO OFFICIAL RULES:

Participation in the Contest constitutes Entrant's full and unconditional agreement to and acceptance of these Official Rules and decisions of Sponsor which are final and binding in all respects.

4. PROMOTION PERIOD:

Contest begins on or about February 1st 2009 to April 30th 2009. AEST or while prize supplies last, whichever is the earlier ("Contest Period"). The Contest Period may vary per country due to variant prize quantities per country. All Entries (defined below) must be received within the Contest Period applicable for the Entrant's country of legal residence.

5. ENTRY:

To enter, log onto, www.cisco.com/go/anz/gamechanger. During the Contest Period applicable for your country of legal residence, fill out the registration form, and enter your answer to the contest question(s). After entering this information and clicking on the "Submit" button, you will immediately receive one (1) Contest entry. LIMTED TO ONE (1) ENTRY PER COMPANY. Multiple entries will be disqualified. Entries received prior to or after the Contest Period shall be disqualified. Entries will be scored and you will be notified via email or on the contest website of your result. Entrants who receive notification of having answered correctly will be considered eligible entrants ("Eligible Entry").

In the event of a dispute as to any entry, the authorized account holder of the email address used to enter will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an email address by an internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address.

Notwithstanding anything in these terms and conditions, Sponsor reserves the right at any time in its absolute discretion to: (i) Cancel or modify the Contest, or any part thereof; (ii) Determine and/or amend, by addition to, deletion from or variation of, these terms and conditions without prior notification, including but not limited to, the eligibility terms and criteria for the Contest, the selection of winners, and the timing and venue of any act to be done, and all Eligible Entrants and winners shall be bound by such determination and/or amendments; and (iii) Substitute, withdraw or cancel any prize without prior notice and without having to disclose any reason thereof and without any payment or compensation whatsoever. Sponsor assumes no responsibility for lost, stolen, late, incomplete, invalid, illegible or misdirected submissions or claims; for failed, partial or garbled computer transmissions; or for technical failures of any kind, including, but not limited to electronic malfunctioning of any network, hardware, or software or electronic or human error which may occur in the transmission of any information related to this promotion or in the processing of claims.

6. JUDGING:

On or about 1st June 2009, 10 potential winners will be selected by a panel of SMB experts in Australia ("Judges") whose decisions as to the selection of the potential winner are final. Judges will select the potential winners according to the following criteria (collectively, the "Judging Criteria"):

Each company will be required to meet with a Cisco representative / and or nominated Cisco Partner to undergo a further round of questions to ascertain which entries will benefit from a Cisco solution the most. This evaluation will include inspection of current IT infrastructure & information about Telecommunications set up for each entrant.

  • Selection criteria for the 4 winners will be based on merits of the above more detailed analysis of each entrant's communications needs & selected by a panel of SMB experts.
All decisions by the Judges are final.

7. PRIZES:

Winners will receive a [Cisco Changing the Game – Communications Makeover), which will consist of up to $50 000* of Cisco communications equipment (* RRP) deployed at the business location of the 4 winners of the competition.] Approximate Retail Value ("ARV") Australian dollars, [__$50 000__]. Installation or service will be provided via a nominated Cisco SMB Select Partner up to the value of $5000 . The winners cannot select a preferred IT Partner & will be required to sign off on completed work with Cisco and Cisco SMB Select Partner. The total number of prizes is approximately [_4___] and the ARV of all prizes is approx.: [_$50 000___] Australian dollars. 1 yr service – Cisco smart net will be provided on the Cisco equipment.

Winners will be required to sign an acceptance of solution.

The winners will need to agree to Cisco requiring them to partake in a Cisco case study which could be both written case study and /or Video case study. In some cases the winners will be asked to participate in the SMB TV program "Kochie's Business Builder" a highly regarded SMB business program run on the Channel 9 Network in Australia

8. IMPORTANT NOTICE:

IMPORTANT NOTICE: Currency exchange rates may vary at time of prize award. Limit one (1) prize per person. SPONSOR IN NO WAY ENDORSES THE CONTENT, ACCURACY OR VERACITY OF THE QUIZ. SPONSOR AND PRIZE SUPPLIERS MAKE NO WARRANTY, REPRESENTATION OR GUARANTY, EXPRESS OR IMPLIED, IN FACT OR IN LAW, RELATING TO ANY PRIZE INCLUDING BUT NOT LIMITED TO ITS QUALITY OR SUITABILITY AND SPONSOR AND PRIZE SUPPLIERS HEREBY DISCLAIM ANY RESPONSIBILITY OR LIABILITY RELATING THERETO. Cash equivalent of prizes will not be awarded. Difference between ARV and actual values will not be awarded. No cash or other substitutions are permitted except at the discretion of Sponsor who reserves the right to substitute a prize of comparable or greater value if the prize is unavailable or cannot be awarded as described for any reason. All sales taxes, and any other costs, fees and expenses, charges, with the exception of delivery costs which will be borne by the Sponsor, on a prize are the sole responsibility of winner. Delivery shall be by overnight courier/registered post (as determined by the Sponsor) to the address furnished by the winner as reflected in the registration page. Any and all federal, state, provincial or local taxes, fees, duties and surcharges on prizes are the sole responsibility of the winner. Prizes awarded to any winner who is an employee of a federal, state, provincial or local government organization will be subject to applicable ethics laws and regulations.

9. WINNER SELECTION:

WINNER SELECTION: During or within 30 days after the Contest Period, the Sponsor will review all Entries and the first Entrants (up to the quantity of prizes available per country) to have submitted an Eligible Entry will be contacted by email, on the website, by telephone or post, at Sponsor’s discretion, and notified of his/her potential winner status. Potential winners may also be required to sign and return a Statement or an Affidavit of Eligibility and Release of Liability/Publicity within fifteen (15) business days of the date such affidavit and release are postmarked (if sent via mail) or the date the email was sent (if sent by email). In the event of noncompliance, or if the winner cannot be reached via the contact information provided on winner's registration, or if the prize or prize notification is returned as unclaimed or undeliverable, the prize will be forfeited and an alternate winner will be selected.

10.GENERAL CONDITIONS:

Sponsor reserves the right to cancel or modify the Contest if any attempt is made to cheat or engage in fraud, or any other factor beyond Sponsor's reasonable control impairs the integrity of the Contest, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any Entrant it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor reserves the right to contact any Entrant in order to verify the information provided in the Entry. Sponsor reserves the right to require verification from the potential winners. Sponsor's failure to enforce any provision of these Official Rules shall not constitute a waiver of any provision. Sponsor reserves the right to refuse acceptance of an Entry without the need to furnish any explanation nor to entertain any queries by Entrants. In the event of a query or dispute, Sponsor's decision shall be final.

11. USE OF PERSONAL INFORMATION:

Personal information submitted while participating in the Contest will be used only to contact potential winners unless Entrant has checked the Opt-In box on the registration page. Such personal information will not be used for any other purpose. Personal information means any information that may be used to identify the individual making the entry including, but not limited to, a first and last name, an email address, a home, postal or other physical address, other contact information, a title, a birth date, such individual's gender, occupation or industry, or other information needed to meet the obligations of the Contest. If the Opt-In box has been checked, Entrant grants to Sponsor and its affiliates an irrevocable right to print, reproduce, publish, use, edit, adapt, display, broadcast and/or modify worldwide in any way, in any and all media, now known or hereinafter developed (without compensation to Entrant), including, but not limited to, the World Wide Web and the Internet, at any time(s), the winner's name and logos, and the name, portrait, picture, voice, likeness, and biographical information of the individual who entered on behalf of the winner, as news, information and for advertising and promotional purposes without additional compensation or review. Checking the Opt-In box further constitutes Entrant's consent to assign and transfer irrevocably to Sponsor any and all rights, title and interest in the Entry, without limitation, including all copyrights. By participating in the Contest and to the fullest extent under applicable laws, Entrant waives the benefit of any provision of law known as "moral rights" or "droit moral" or any similar or analogous law or decision in any country of the world and represents and warrants to Sponsor that its submission does not contain any third party confidential or proprietary information.

12. WARRANTY:

EXCEPT FOR WARRANTIES AND CONDITIONS IMPLIED BY LAW WHICH CANNOT BE EXCLUDED, SPONSOR MAKES NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE QUALITY OR SUITABILITY OF THE PRIZE. Certain legislation may imply conditions or warranties which cannot be excluded, restricted or modified except to a limited extent. In this event, sponsor's liability is limited to, as its option: (i) the replacement of the prize or the supply of an equivalent prize; (ii) the repair of the prize; or (iii) the payment, if it does not contravene any law, of the cost of the replacement, supply or repair.

13. LIMITATIONS OF LIABILITY:

BY PARTICIPATING AND ACCEPTING A PRIZE, EXCEPT FOR LIABILITY UNDER STATUTE WHICH CANNOT BE EXCLUDED, EACH WINNER AGREES THAT SPONSOR, ITS SUBSIDIARIES, AFFILIATES, ADVERTISING AND PROMOTION AGENCIES, AND ALL OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, WILL HAVE NO LIABILITY WHATSOEVER FOR, AND WILL BE HELD HARMLESS BY WINNER FOR ANY CLAIMS, LIABILITY, OR CAUSE OF ACTION FOR ANY INJURY, LOSS OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING WITHOUT LIMITATION PROPERTY, DUE IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THE DELIVERY, ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZE, PARTICIPATION IN THIS CONTEST, OR PARTICIPATION IN ANY CONTEST OR PRIZE RELATED ACTIVITY. FOR THE AVOIDANCE OF DOUBT, NOTHING HEREIN EXCLUDES OR LIMITS THE SPONSOR'S LIABILITY FOR DEATH OR PERSONAL INJURY RESULTING FROM NEGLIGENCE, FRAUD OR WILFUL MISCONDUCT.

14. DISPUTES:

Except where prohibited by law, Entrant agrees that any and all disputes will be resolved in the appropriate courts in the State of California in the United States under the laws of the State of California. Should there be a conflict between the laws of the State of California and any other laws, the conflict will be resolved in favor of the laws of the State of California.
