BEDINGUNGEN UND KONDITIONEN

A.

This Program does not apply to Eligible Cisco Products not purchased within the Program Period or purchased more than three (3) years from the Initial Purchase of the Eligible Linksys Product.

B.

Eligible Linksys Products means new Linksys products, as determined by Linksys, which are eligible for trade-up under this Program ("Eligible Linksys Products"), the list of which is available at this site www.cisco.com/go/linksys-tradeup . Eligible Cisco Products means new Cisco products, as determined by Cisco, which Customer can purchase as a replacement for the Eligible Linksys Products under this Program ("Eligible Cisco Products"), the list of which is available at this site www.cisco.com/go/linksys-tradeup (collectively "Eligible Product").

C.

Cisco reserves the right to modify the Product Eligibility List. Any modifications to the Product Eligibility List shall be communicated to Customers by posting on the Cisco Program website at this site www.cisco.com/go/linksys-tradeup . The applicable Product Eligibility List and associated Rebate Amount is that which was in effect at the time the applicable Eligible Linksys Product was purchased. For Eligible Linksys Products purchased before commencement of the Program, the Product Eligibility List posted as of the commencement of the Program and the associated Rebate Amount shall apply. Cisco will use commercially reasonable efforts to make all versions of the Product Eligibility List available on the Program website during the Program Period.

D.

All Eligible Linksys Products and Eligible Cisco Products are subject to availability, while quantities last, and Cisco reserves the right to change the Program based on product availability.

E.

This Program is not valid on leased, returned, refurbished or used products, or products purchased through Internet auctions or any other unauthorized channels.

A.

What is the E-voucher and how is it validated?
All Customers who register and confirm for the Program will receive their rebate via an E-voucher. The Customer will request the E-voucher on this Program web-site www.cisco.com/go/linksys-tradeup by confirming that the Customer is ready to buy a Cisco Eligible Product. Once the Customer has decided which Cisco Eligible Product to purchase, as part of the Program, the online E-voucher request will be validated for compliance after receipt, and if properly submitted and eligible, the request will be approved and an E-voucher will be sent. The E-voucher will be sent electronically to the Customer through e-mail that is specified on the initial online request. The Customer may then purchase a Cisco Eligible Product. The E-voucher amount will be deducted at the point of sale.

B.

Voucher Validity Period
All vouchers must be requested within the Program Period and within three (3) years from the date of Customer's Initial Purchase of the Eligible Linksys Product . All vouchers received are valid for a period of one (1) year after validation date.

C.

Returning your Linksys product
After receiving the E-voucher for the Program the Customer will be called by Cisco to make an appointment for a pick-up or return of the Eligible Linksys Product within ninety (90) days of purchase of the Eligible Cisco Product. Customer is not allowed to keep the Eligible Linksys Product after having submitted the E-voucher with the purchase of an Eligible Cisco Product. If the Eligible Linksys Product is not returned to Cisco per this process, Customer will be charged for the E-voucher amount.

D.

NON-CONFORMING SUBMISSIONS WILL BE AUTOMATICALLY DISQUALIFIED . Non-conforming submissions are those that are not capable of correction via clarification or verification, and include, without limitation, claim submissions from ineligible participants, or that do not contain a returned Eligible Linksys Product, that do not pertain to Eligible Linksys Products or Eligible Cisco Products, where the number of Eligible Linksys Products returned for a trade-up is inconsistent, or where an Eligible Cisco Product was not purchased or the registration was not received within the time frames specified herein.

E.

If for any reason the E-voucher request is disqualified or is ineligible, within two to three weeks of such decision, Cisco will return to the Customer any and all Linksys Products previously submitted with the claim. Rebate claim documentation will not be returned and becomes the property of Cisco.

F.

The name of the Customer on the Invoice must be the same as the Organization name on the E-voucher. Any rebate claim mailed to Cisco or any address other than that on the Rebate Instruction Form will not be processed for the offer.

G.

One E-voucher is only valid for one Eligible Cisco Product.

H.

At its discretion, Cisco and its designated representative reserve the right, without obligation, to request additional information and verify the accuracy and sufficiency of all information provided by Customer.

I.

In the event an Eligible Cisco Product for which an E-voucher has been approved or issued is returned within four (4) months, Customer will be refunded the price paid minus the Rebate Amount specified in the E-voucher.

J.

All Eligible Linksys Products must be received by Cisco within ninety (90) days of purchase of the Eligible Cisco Products otherwise Cisco will charge Customer for the E-voucher Rebate Amount.

K.

The decisions of Cisco and its authorized representative are final and binding in all matters relating to any E-voucher claim and this Program.

A.

This Program may not be combined with any other promotion, discount, or trade-up program offered by Cisco.

B.

Cisco reserves the right to modify or terminate the Program at any time in its sole discretion. Any such modification or termination notice will be posted at this site www.cisco.com/go/linksys-tradeup . After termination, and if reasonably commercially feasible, Cisco will use commercially reasonable efforts to honor all eligible and approved rebate requests received by Cisco prior to the date of termination.

C.

Customers are solely responsible for compliance with their Company policies regarding participation in rebate programs and agree to assume all such risks relating thereto.

D.

Customer must warrant that they hold legal title to their Initial Purchase (free of liens, security interests, or other encumbrances), and they have the legal right to transfer title to Cisco upon trade-up of the Product.

E.

Without limiting any other right retained herein, Cisco reserves the right, in its sole discretion, to immediately cancel or immediately suspend the Program without prior notice should a force majeure event, virus, bugs, unauthorized human intervention, or other similar or dissimilar cause beyond the control of Cisco, in Cisco's sole opinion, corrupt the administration, security, fairness, integrity, or proper operation of the Program.

F.

Cisco and its fulfillment house shall not be responsible for any late, lost, stolen, misdirected, illegible, incomplete or postage due claims/requests. Please be sure to keep a copy for your records of your entire claim and all documents submitted. Cisco is not responsible for any printing, human, fax, computer or other errors, however they may arise. Submission of false, inaccurate, intentionally incomplete, or misleading claims in connection with the Program, will disqualify the claim, and may subject Customer to civil liability or criminal prosecution.

G.

All documentation submitted for this Program becomes the property of Cisco and will not be returned.

H.

This voucher offer is not transferable.

I.

All decisions by Cisco and its designated representatives are final.

J.

If any provision of these Terms and Conditions, or the application of any provision to any participant or circumstance, is held invalid, the remainder of these Terms and Conditions, and the application of the provision other than to the extent it is held invalid, will not be invalidated or affected.
