This appendix provides software license information related to the TV CDS.

Product Warranties

The following sections detail Cisco Systems, Inc. warranty policies.

Standard Warranty

Cisco Systems, Inc. ("Cisco Systems, Inc.") warrants that all hardware shall be free from defects in material and workmanship for a period of thirty (30) days under normal operating conditions from the product shipment date. Cisco Systems, Inc., at its sole option, will either repair or replace the nonconforming hardware. Hardware replaced under the terms of this warranty may be refurbished or new equipment substituted at the option of Cisco Systems, Inc. Any replacement or repaired equipment provided to you will not extend the period of the original warranty. You acknowledge and agree that the provisions of this warranty constitute the sole and exclusive remedy available to it with regard to defective hardware. This limited warranty shall not apply to defects resulting from neglect, misuse, electrical or electro-magnetic stress, accident, fire and other hazard, unauthorized alteration, modification or repair, including without limitation, installation of unauthorized parts, improper testing, handling, storage, operation, interconnection with installation or any other cause beyond the range of normal use of the hardware.

Returns

Any hardware can be returned only with the prior approval of Cisco Systems, Inc. Any such return shall reference a return material authorization (RMA) number issued by authorized Cisco Systems, Inc. service personnel. Transportation costs, if any, incurred in connection with the return of defective hardware to Cisco Systems, Inc. shall be borne by you. Cisco Systems, Inc. shall pay any transportation costs incurred with the redelivery of a repaired or replaced item. If Cisco Systems, Inc. determines that the allegedly defective hardware is not covered by the terms of this warranty or that a warranty claim is made after the warranty period, the cost of repair by Cisco Systems, Inc., including all shipping expenses, shall be paid by you.

Infringement

Cisco Systems, Inc. retains the exclusive right to defend and pay damages finally awarded and/or settle any claim(s) by a third party against you based upon on a Cisco Systems, Inc. product (excluding any Third Party content therein) infringing a patent, trademark, or copyright or misappropriation of any trade secret. The foregoing obligations are conditioned on your providing Cisco Systems, Inc. with prompt written notice of claim(s) or any threat of such a claim(s), and giving Cisco Systems, Inc. full assistance in connection with such defense and/or settlement and on your not being in breach of your obligations hereunder. If the Cisco Systems, Inc.'s product becomes or is likely to become the subject of such a claim, Cisco Systems, Inc. at its sole option may settle any such claim(s), procure for you the right to continue using the product or replace or modify the Product to avoid infringement asserted. Cisco Systems, Inc. will have no obligation or liability relating to or arising from (a) any use of any product (i) not in accordance with this agreement or for purposes not intended by Cisco Systems, Inc. Cisco Software License

Subject your compliance with the terms of this license and payment of all amounts owed for your use of the software, Cisco grants to you a non-exclusive license to the Content Delivery Applications (the "Software"), solely for your internal business purposes and solely in accordance with the Documentation. You may use the Software on the provided installed system (the "Hardware") or may transfer the Software to a single hard disk, provided you remove the Software from the original Hardware. You may create one copy of the Software for archival purposes. Any use of the Software other than in accordance with this license will result in immediate termination of the license.

In connection with your use of the Software you acknowledge that the Software constitutes valuable trade secrets of Cisco.
